South Dakota, 14 Other States Challenging EPA On Water Rules

State Attorneys General from 15 states including South Dakota have written EPA opposing their proposed Waters of the U.S. and Interpretive rules. South Dakota Attorney General Marty Jackley says the group believes EPA is exceeding its authority and hasn’t received sufficient input from those affected.

Jackley says he and his fellow Attorneys General think EPA has narrowed the scope of normal farming activities permitted under the Clean Water Act by limiting them to 56 practices and has overstepped its authority.

Jackley also says it’s inappropriate for EPA to make NRCS the enforcer of those conservation rules when they don’t have the power or authority to do that.
