Sentencing Date Set For Fajardo

On Election Day, a number of futures will be decided, including how long a convicted rapist will stay behind bars.. November sixth is the date, set for the sentencing of Werner Fajardo. The 35-year-old Sioux Falls bar owner was found guilty of getting a twelve year old and two 14-year-olds drunk, then sexually assaulting them at the former El Cuervo Bar and Dance Hall in Huron. The El Cuervo closed after Fajardo’s liquor license was revoked by the State Department of Revenue in January. The victim’s testified in court, that Fajardo picked them up and drove the three to the El Cuervo after the bar had closed. Fajardo was found guilty in mid-August and Beadle County States Attorney Mike Moore anticipated a sentencing date may take awhile to be finalized…

Fajardo was convicted on eight counts including first degree rape, where the maximum penalty is life in prison. The other counts include. three counts of Third Degree Rape, two counts of Fourth Degree Rape, and a single count each of sexual contact with a person incapable of consent and violating South Dakota alcoholic beverage laws.
