Neighbors Object To Covenant Removal

A request to have a restrictive covenant removed from a parcel of land that was a part of a prospective land sale has been withdrawn by the applicant. Jeff VanGerpen made the request to have the covenant that restricts the removal of trees from lots along Cardinal Lane, lifted for what is described as Lot 50, the only lot under the covenant that has street access, in this case to 18th Street. The Huron City Commission heard the request last week, but pushed back any possible action to last night, so that residents around Lot 50 could be notified of the possible change and give input. Borkowski says what a land owner places in their back yards is not dictated by the covenant. However, further objections came from home owners like Rich Bragg who says the covenant is why he bought his home on Cardinal Lane….

Other neighbors also objected. Mayor Dave McGirr says the objections to lifting the covenant, is exactly why the City Commission waited to make a decision…

The group working on the Lot 50 issue was asked to talk about coming to a possible agreement outside of the City Commission Chambers while the Commission finished one agenda item and held an executive session. They invited the parties back in following those items at which time Van Gerpen to the Commission he was withdrawing his request for the time being.
