A Lane man has been released from the Human Services Center to family in Jerauld County following a competency hearing Tuesday in Huron. The defense attorney for 61-year-old Martin Moeller, Aaron Pilcher, asked Judge Jon Erickson to release his client to family based on information included in the latest evaluation of Moeller’s mental status. Pilcher told the court that after talking with Moeller he wants to move forward. The report indicated that Moeller understands the charges against him and can assist with his defense. Moeller has pleaded not guilty by reason of insanity to first-degree robbery and commission of a felony with a firearm. Court documents accuse Moeller of walking into the Super X convenience store in July of 2014 and brandishing a long barreled revolver and taking two bottles of soda pop. He accused of retrieving the revolver after finding out he was short of money to purchase the drinks. Beadle County Deputy States Attorney Dan Nelson did not object to the request to release Moeller. He did ask that Moeller be required to take an injectible anti-psychotic medication every 28 days and if he misses a shot or refuses treatment, that he go back under care. An arraignment is tentatively scheduled for April 21st.
