The Mitchell City Council has declared the building at 301 North Main Street a nuisance and is seeking court action to mitigate the problem. The resolution said the structure is a safety hazard with a risk of collapsing, broken windows, vermin and impeding traffic on the 100 block of West Third Avenue. Three street has been closed since last July while the owner attempted repairs which stalled.
City Attorney Justin Johnson says it’s possible the structure ends up demolished…
Johnson says if the court orders the building demolished, it’s unclear at this time who’s responsible for the cost.
He says it’s possible to assess some of the costs against the property or possibly seek a personal judgement against the property owner.
Johnson says there’s no timeline on how soon the issue is resolved and the 100 block of West Third Avenue is once again entirely open to traffic.
