A Davison County judge yesterday ruled that statements a man accused of murder made to police will be included as evidence in the case.
A suppression motion requested by the attorneys of 50-year old Anthony Lewis was denied by Judge Chris Giles. Lewis is accused of stabbing Quinn Schleuning at Lewis’s apartment in downtown Mitchell in August of 2017.
During initial questioning after the incident by police, Lewis did say “I get a lawyer.” Once a request is made for a lawyer, law enforcement interrogation must cease. However, Judge Giles ruled that the statement made by Lewis was not a clear request for a lawyer.
Lewis also later actively engaged a different detective, discussed the case with him, and waived his Miranda rights by signing a waiver form. Lewis is charged with first and second-degree murder and could face life in prison if convicted.
A jury trial is expected to take place later this year.
