Huber Seeking Third Retrial

SIOUX FALLS, S.D. (AP) – A former South Dakota police chief convicted of killing his wife is asking a federal judge to overturn his conviction.
Kenneth Huber filed a motion in federal court in which he argues that his lawyers should’ve objected to the admission of some evidence against him.
Huber says the presiding judge in Hyde County allowed four days of prejudicial character evidence that included allegations of domestic violence.
Huber was first convicted of murder in 2008 in the death of his wife, Pam. The South Dakota Supreme Court overturned that conviction, but Huber was convicted of first-degree murder in a second trial held in 2011 in Huron.  Huber contends his pistol fired accidentally when he moved it from a bedroom dresser to a gun safe.
