A committee hearing on a proposal that would clear a person of ever being charged with a crime is moving to consideration by the South Dakota House. The House Judiciary Committee took nearly an hour’s worth of testimony on House Bill 11-34 on Wednesday. Bill sponsor, Representative Dan Kaiser of Aberdeen suggested the law must be changed following the case of former Brown County deputy States Attorney Brandon Tailaferro, who was changed in a witness tampering case…
Beadle County States Attorney Mike Moore acted as a special prosecutor for Brown County on that case and opposes Kaisers bill and his public cheap shot…
South Dakota Attorney General Marty Jackley also testified against the bill. Representative Mike Stevens of Yankton says the bill is about keeping the legal system fair…
HB 11-34 passed out of the Judiciary Committee on a nine to three vote.
