An Iroquois man is sentenced to 90 days in jail for a fatal traffic accident in 2008. Kyle Gross received the sentence Tuesday at the Beadle County Courthouse. Defense attorney Mike Bulter told Judge Jon Erickson that letters received as part of the pre-sentence investigation distorted who Kyle Gross was, and cited many examples of kind and generous things Gross has done for neighbors. Bulter also says Gross was informed recently he has prostate cancer, and wanted Erickson to consider the possibility of treatment and surgery when sentencing the 53-year-old. Prosecutor Mike Moore showed the assembled galley a number of pictures of the truck that caused the accident. The truck had many rusted out and corroded areas near the suspension and braking systems. Moore said only four of the trucks brake were working properly and the brakes could have been repaired for 2178 dollars. Erickson said it was one of the hardest sentencings hes had to sit through in 30 years on the bench saying quote ” I’m not sure there is a good answer”. Erickson also said he was struck by how the death of Barbara Walter had impacted Gross. In addition to jail time Gross was given two years of probation and a five-thousand dollar fine. Any restitution will be determined at a future hearing. Erickson also granted a suspended imposition of the sentence. Gross will be required to maintain his fleet of truck or risk violating probation. A request for work release will be considered in 30-days.
