Governor Daugaard this week signed Senate Bill 25 into law. It deals with the release of jail booking photos—known as mugshots—to the media and the general public.
Right now, South Dakota Attorney General Marty Jackley says it’s a misdemeanor for law enforcement to release those photos. But with Senate Bill 25 becoming law, that changes, effective July first
Jackley was asked about the argument that these photos will be released when someone is only “charged” with a crime, and not “convicted”
Jackley says South Dakota will become the 49th state to allow the release of routine booking photos. Louisiana is the only state that does not allow it.
