PIERRE, SD – Final jury selection is this afternoon and opening statements will be held Tuesday Afternoon in Huron in the second murder trial of a former South Dakota police chief who argues it was an accident when he shot his wife in the head. Lawyers for both sides will select 20 jurors each, then pair those down to 15, 12 primary and 3 alternates. Ken Huber was sentenced to life in prison without parole after a jury convicted him in December 2008. But the South Dakota Supreme Court overturned that conviction last year. The high court says the former Highmore police chief is entitled to a new trial because he was never allowed to fully argue his case in the first trial that the shooting was accidental. Huber told investigators his pistol fired accidentally in October 2007, and the bullet hit his wife, Pam Huber, in the forehead as she lay on a bed. Prosecutors say it was no accident.
