Father And Son To Be Tried Separately On Sex Crime Charges

A decision on whether or not a rural Cavour man will be tried in adult court on rape charges is in hands of Circuit Judge Tim Tucker. Tucker received a psychiatric evaluation of 18-year-old Jordan Sylaart during a motions hearing Wednesday with his father Fred Sylaart. Fred Sylaarts attorney Carmen Means requested the cases of Fred and Jordan be tried separately since the cases involve different types of charges. Prosecutors did not object and Tucker granted the motion. Means is attempting to get Jordan Sylaart’s case transferred to juvenile court since he was under 18-years-old when the alleged crimes occurred.  Jordan Sylaart is charged with two counts of first-degree rape, while his father Fred is charged with two counts of sexual contact with a child under 16-years-old. The alleged victims in the case are under 12-years-old and were attending a home day-car operated by Fred Sylaart’s wife. A trial date for Jordan Sylaart was set for May 14th to the 16th. Fred Sylaart’s trial will be June 12th to the 14th. A new special prosecutor is taking over the case.  Codingtion County States Attorney Dawn Elshere is assuming the role of prosecutor from former Brown County States Attorney Kimberly Dorrsett who is withdrawing for personal reasons. The Beadle County States Attorneys Office is using a special prosecutor to avoid a conflict of interest in the case, since Fred Sylaart was a former janitor at the Beadle County Courthouse. His employment with the county was terminated shortly after being indicted by a Grand Jury on the charges.
