Fajardo Pleads Not Guilty To Rape And Other Charges

The Sioux Falls man facing 15 counts including rape and giving alcohol to minors has pleaded not guilty in Beadle County Circuit Court. Werner Fajardo entered not guilty pleas on two criminal files against him. One file contains the more serious sexual assault crimes, while the second file involves a charge of violating South Dakota beverage laws for serving alcohol to minors in the El Cuervo Bar in Huron. Two trial dates were set as well with a trial on the beverage law violation set for February 23rd. The trial date for the sex crime allegations is set for March 28th. Motions hearings are set for January 17th and February 28th. Fajardo’s court appointed attorney Jeff Burns request for Grand Jury transcripts was approved by Judge Jon Erickson. Fajardo was also granted access to a folder to review transcripts and other papers. The only objection from Beadle County Deputy States Attorney Jeff Banks was that Fajardo not be allowed to replicate any court filing in the folder. Fajardo was arrested last month following a Huron police investigation regarding complaints of activities taking place after closing time at the El Cuervo, which Fajardo owns and operates.
