Sylaart Sentenced In Day Care Sex Abuse Case

After a number of delays a rural Cavour man has finally been sentenced after being found guilty of sexual contact with a child under 16-years-old. Judge Tim Tucker sentenced Fred Sylaart to 90 days of jail time at the Beadle County Regional Correctional Facility as part of the suspended execution of sentence requested by Sylaart’s attorney David Wheeler…

Via I-T-V from Watertown, special prosecutor Dawn Elshere told Tucker Sylaart should be given the minimum mandatory sentence required by state law of ten years for his contact with a child, who attended the now closed, home daycare operated by his wife. Elshere said in court the long term impact on the victims is unknown and that Sylaart has not taken responsibility for his actions. She called information revealed in the psycho-sexual evaluation “disturbing”. Wheeler said after the sentencing, is client is not a risk to the community….

Wheeler took issue with the way portions of the psycho-sexual evaluation were done as he pleaded with Tucker for a lesser sentence. Sylaart was given work release to go with his 90-day jail term. He is will be on probation for 30 months. He was ordered to pay one-thousand dollars in fines and court costs, one-thousand dollars to cover victim counseling and court appointed attorneys fees. Sylaart will be subject to random polygraph tests, must stay away from unrelated children under 16 and enroll and complete outpatient treatment. Sylaart’s son Jordan was sentenced in a similar manner in May, receiving a suspended execution of sentence on a three-year penitentiary term. He served 90-days in the Beadle County Jail and has since been released.
