The 281 Travel Center in Wolsey has pleaded no contest to a charge of selling mislabeled fuel. Kent Shelton, the attorney representing 281 Travel Center owner Robert McGillvray told Magistrate Judge LeeAnn Pierce Wednesday that his client made a contract with M-G Oil company of Rapid City for delivery of 87 octane fuel, but M-G Oil sent a shipment of low-grade 85 octane fuel instead. That fuel was then filled in tanks attached to pumps labeled 87 octane. As a part of the plea agreement, Beadle County prosecutors agree to acknowledge that the 85 Octane fuel was delivered to the truck stop on Wolsey’s south side without McGillvrary’s knowledge. In making the no contest plea, the 281 Travel Center was fined 500 dollars and sentenced to 15 hours of community service. On November 14th, M-G Oil pleaded No Contest to it’s own seres of similar charges. They also entered no contest pleas to five of six charges of selling mislabeled fuel at the five Corner Pantry stores it owns in Huron. M-G Oil was fined a total 25-hundred dollars, 500 for each count and ordered to perform 100 hours of community service. The charges were the first charges filed and prosecuted in South Dakota for selling mislabeled gasoline.The sale of 85 octane fuel is outlawed in South Dakota except for nine counties west of the Missouri River.
