New Trial Dates For Iroquois Men Charged With Manslaughter

An Iroquois father and son charged with manslaughter in a fatal 2008 traffic accident in Huron will be tried separately. A motion to combine the trials of Brady and Kyle Gross was denied Tuesday by Beadle County Circuit Judge Jon Erickson. States Attorney Mike Moore told Erickson he does not want to be precluded from using evidence including statements made by Brady Gross at the scene of the crash that could possibly be used against his dad. Moore told Erickson he plans on submitting both men’s complete depositions and that the depositions could be used against each other A trial date had been scheduled for November 17th, but Moore told the Judge he never received that information. Erickson confirmed that the November trial date had been filed and both defense lawyers confirmed getting that date. Erickson set Brady Gross’ trial for January 5th. Kyle Gross’ trail will start March 2nd. A defense motion to exclude expert witnesses was denied. Erickson approved the creation of a jury questionnaire. The questionnaire should be ready in a week. Court documents maintain Brady Gross was at the wheel of a semi-truck owned by Kyle Gross, when the brake system on the truck failed and slammed into a car driven by 59-year-old Barbara Walter of Washington State.
